        Important: By downloading, installing, or using the Scania SOPS Editor software, or by using this website, you confirm that you have read, understood, and agree to these Terms of Use in their entirety. If you do not agree, do not use the service.
    

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Scania SOPS Editor desktop application ("Software") and the associated online platform at this website ("Platform"). By creating an account, purchasing a license, downloading, installing, or using the Software in any way, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

The Scania SOPS Editor is a desktop application for Windows that provides tools for editing Scania SOPS (Scania Onboard Product Specification) files, modifying ECU configuration parameters, deleting DTCs from binary ECU files, and (in upcoming releases) managing emission derate parameters in binary files. The Platform provides license activation, account management, software downloads, and technical support.

The Software is a technical tool. It performs actions at the direction of the user. The Software itself has no knowledge of, and does not make any determination about, the legal or regulatory status of any action taken by the user in any jurisdiction. All decisions about what to do with the Software are made exclusively by the user.

3. License Grant

Upon purchasing a valid license, we grant you a non-exclusive, non-transferable, machine-bound license to install and use the Software on a single computer identified by the hardware key generated during installation, for the duration of your active subscription.

You may not:

Copy, distribute, sell, or sublicense the Software to any third party
Reverse engineer, decompile, or disassemble the Software
Use the Software on more machines than covered by your active licenses
Remove, alter, or obscure any copyright notices or proprietary markings
Share your account credentials with third parties

4. User Responsibility — Full and Exclusive

YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL MODIFICATIONS YOU MAKE USING THIS SOFTWARE.

By using the Software, you accept full, unconditional, and sole responsibility for every action taken, every file modified, every parameter changed, and every consequence — intended or unintended — that results from your use of the Software. This responsibility cannot be transferred to, shared with, or attributed to the developer or provider of this Software under any circumstances.

You are solely and exclusively responsible for:

Determining whether your intended use of the Software is lawful in your specific jurisdiction, country, region, and context of use. We do not provide legal advice and make no representation about the legality of any specific action in any specific location.
Creating complete backups of all original ECU files and vehicle data before making any modifications whatsoever.
The technical correctness, safety, and fitness for purpose of every modification you make to any ECU file, binary file, or SOPS file.
All consequences of flashing, programming, or applying any modified file to any vehicle or control unit, including but not limited to: ECU corruption, vehicle malfunction, safety risks, warranty voiding, and vehicle damage.
Ensuring that any vehicle modified using this Software is operated only in contexts and locations where such modifications are legally permitted.
Any legal, regulatory, financial, or criminal consequences arising from your use of the Software in your jurisdiction.
Any damage to vehicles, engines, ECUs, electronic control units, sensors, actuators, or any other hardware resulting directly or indirectly from use of the Software.
Any third-party claims arising from modifications you make using the Software, including but not limited to vehicle owners, operators, insurers, or regulatory authorities.

5. Emission Control Systems — Jurisdiction and User Responsibility

Read carefully before using any emission-related feature. Emission legislation varies significantly by country and application. It is your sole responsibility to determine what is lawful where you are and for your intended use case.

The Software includes features that interact with emission control system parameters (including but not limited to SCR/AdBlue, EGR, DPF, NOx sensors, and emission derate flags). These features exist because their use is lawful, standard practice, and commercially normal in many parts of the world and many application contexts, including:

Countries and regions that have no applicable emission legislation for heavy vehicles
Export vehicles destined for markets without emission requirements
Off-road use in agriculture, mining, forestry, construction, and industrial applications
Marine and stationary engine applications not covered by road vehicle regulations
Closed-circuit testing, motorsport, and track-only vehicles
Vehicles operating in private land or environments outside public road jurisdiction
Diagnostic and research purposes where the vehicle does not return to road use
Fleet operators in jurisdictions where specific modifications are explicitly permitted

You, the user, are solely responsible for knowing and complying with the laws, regulations, and standards applicable in your country, region, and specific use case. We do not monitor, control, or have knowledge of where or how the Software is used. We provide no advice on whether any specific modification is lawful in your jurisdiction. We make no representation that any particular use is legal or illegal in any location.

In jurisdictions where emission modifications on road-going vehicles are regulated or restricted (including, by way of non-exhaustive example, EU Regulation EC 595/2009, US EPA regulations, and equivalent national laws), compliance with those regulations is entirely your own responsibility. If you are in doubt about the applicable rules in your location, you must consult a qualified legal professional before proceeding.

We accept zero liability for any use of emission-related features that violates any law, regulation, or standard in any jurisdiction. Any fines, penalties, enforcement actions, criminal proceedings, vehicle impoundment, or any other consequences resulting from your use of these features are borne entirely by you.

6. DTC Deletion — User Responsibility

The DTC deletion feature allows the user to remove Diagnostic Trouble Codes from binary ECU files. This feature has legitimate professional uses including vehicle preparation for resale in compliant markets, diagnostic workflow, and research. However:

You are solely responsible for ensuring that any use of the DTC deletion feature is lawful in your jurisdiction and context.
Deleting DTCs from a vehicle that is subsequently presented for a roadworthiness inspection, emissions test, or sold to a third party without disclosure may constitute fraud or a regulatory offence in many jurisdictions — this is entirely your responsibility.
We provide this feature as a technical tool only. We make no representation about its lawful use in any specific context.

7. Intellectual Property & Trademark Disclaimer

This software is not a Scania product. It is an independent third-party tool developed without any involvement, authorisation, or approval from Scania CV AB.

The Software, Platform, and all associated content (code, documentation, graphics, interface design) are the intellectual property of the service owner and are protected by applicable copyright and intellectual property laws.

"Scania" is a registered trademark of Scania CV AB, Södertälje, Sweden (Registration No. varies by jurisdiction). All Scania trademarks, trade names, product names, logos, and service marks are the exclusive property of Scania CV AB and are used in this context solely in a nominative descriptive manner — that is, solely to identify the file format, vehicle systems, and technical standards that this software is designed to work with, in the same way that any third-party tool may identify compatible products by name.

This service is entirely independent and expressly:

Is not affiliated with Scania CV AB in any way
Is not endorsed by Scania CV AB
Is not sponsored by Scania CV AB
Is not authorised or approved by Scania CV AB
Is not a partner, agent, or reseller of Scania CV AB
Is not connected to Scania CV AB in any commercial, corporate, or technical relationship
Does not use any proprietary software, data, or intellectual property of Scania CV AB

The use of the name "Scania" in the product name and marketing materials refers solely to the compatibility of this software with the Scania SOPS file format — a technical standard used by Scania vehicles — and does not imply any relationship with or endorsement by Scania CV AB. This use is consistent with the principle of nominative fair use of trademarks as recognised in the European Union (including Directive (EU) 2015/2436) and other jurisdictions.

8. Payment, Subscriptions, and Refunds

All prices are displayed on the Plans page and are charged in EUR.
Monthly and yearly subscriptions renew automatically unless cancelled before the renewal date.
Lifetime licenses are a one-time charge with no recurring fees.
Refunds may be requested within 7 days of purchase if the Software has not been activated, by contacting prrc97@gmail.com. After activation, refunds are at our sole discretion.
Payments are processed by Stripe. By purchasing, you also agree to Stripe's Terms of Service.

9. Software Updates

Free software updates are included for the duration of an active license subscription. We reserve the right to modify, suspend, or discontinue any feature at any time. We will make reasonable efforts to notify users of significant changes.

10. Disclaimer of Warranties

The Software and Platform are provided "as is" and "as available" without warranty of any kind, express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Software will be error-free, uninterrupted, secure, or that any output produced by the Software will be correct, safe, or fit for any purpose. You use the Software entirely at your own risk.

11. Limitation of Liability — Maximum Exclusion

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER AND PROVIDER OF THIS SOFTWARE SHALL BEAR NO LIABILITY WHATSOEVER for any damage, loss, cost, claim, or consequence of any kind arising from the use or misuse of this Software, including but not limited to:

Damage to or destruction of any vehicle, engine, ECU, electronic control unit, or other hardware
Personal injury, death, or property damage resulting from any vehicle modification
Financial loss, including loss of profits, revenue, or business
Legal liability, fines, penalties, or criminal prosecution in any jurisdiction
Loss or corruption of ECU data or vehicle configuration
Failure of any vehicle safety system following modification
Any third-party claim arising from the user's modifications
Any consequence of emission system modifications in any jurisdiction

Our total cumulative liability to you for any claim under these Terms, regardless of the basis of the claim, shall not exceed the total amount you paid for your current license in the 12 months immediately preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Software provider and its officers, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including legal fees) arising out of or relating to: (a) your use of the Software; (b) your violation of these Terms; (c) any modification you make to any vehicle or ECU file using the Software; (d) your violation of any applicable law or regulation; or (e) any third-party claim relating to your use of the Software.

13. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, attempt to bypass the license system, or use the Software in a manner that causes harm to others. Termination for cause does not entitle you to a refund.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Portugal. If you are using the Software from outside Portugal, you are responsible for compliance with local laws.

15. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the service after any update constitutes acceptance of the revised Terms.
